Remote Agreement

 

1. 1. Overall terms and contact information. 

 

This agreement is concluded between the company “Jūrmalas Studija” Sia, registration number: 40003882260, legal address: Skolas street 38-84, Jurmala, LV-2016, Latvia (hereinafter referred to as the Seller) and the Buyer, who makes a purchase in the www.LatvianCrafts.lv online store (hereinafter LatvianCrafts.lv) Remote agreement is applied to all orders made in LatvianCrafts.lv

1.1 When placing an order, the Buyer confirms that he is familiar with the terms contained in this Agreement and agrees to them. The buyer undertakes to familiarize himself with the terms of the Agreement every time he makes a purchase.

1.2. The seller reserves the right to unilaterally amend and supplement the terms of the Agreement at any time. These Terms were last updated on March 17, 2024.

1.3. When placing an order, the Seller needs the Buyer's consent to process personal data, their processing is explained in the "Privacy Policy" section.

2. Placing an order

 

2.1. Orders are placed through the website www.LatvianCrafts.lv to purchase goods, the Buyer can choose to make a purchase with or without registration.

2.2. The seller processes the buyer's orders during his working hours, which are indicated in the "Contacts" section of LatvianCrafts.lv. The Seller sends the Buyer an invoice for accepting the order by e-mail. If the Buyer does not receive a confirmation invoice, then the order has not been accepted.

2.3. The buyer must provide true information about himself when placing an order. If at the time of the order the Buyer's data is incomplete or there is reason to believe that the data is fictitious, the Seller reserves the right not to accept the order for execution.

2.4. The reservation of the product is 5 working days from the moment of the order, the order is canceled if the order is not paid within 5 working days.

2.5. The buyer has the right to cancel his order until the moment of delivery of the goods, by notifying the Seller and specifying the order number.

2.6. The Seller is not responsible for the consequences if, due to the characteristics of the screen of the Buyer's computer or other device, the image of the goods in the online store differs from the appearance of the goods in nature.

 

3. Product prices and discount system

 

3.1. Product prices on LatvianCrafts.lv are indicated in euro currency.

3.2. All LatvianCrafts.lv product prices are indicated with value added tax (VAT). Books and magazines with 12% VAT, other goods – 21% VAT. The price of the product is as it is indicated at the time of placing the order until the obligations are fully fulfilled.

3.3. The product delivery fee is not included in the specified product price.

3.4. Only LatvianCrafts.lv registered Buyers can get an automatic discount.

3.4.1. Discounts do not apply to shipping costs.

3.4.2. The buyer has the right to use discount codes and gift cards. 

 

4. Payment Procedure

 

4.1. When placing an order, the buyer can choose the method of payment for the order - bank transfer, payment with Paypal or cash on delivery upon receiving the product in person at the Seller's office.

4.1.1.  Bank Transfer – after placing the order, a letter containing the order number and the Seller's bank account to which the transfer should be made is sent to the e-mail address specified by the Buyer. When making a transfer, it is mandatory to specify the order number.

4.1.2. Paypal – after completing the order, the customer is directed to the Paypal payment portal, where the Buyer can pay for the order using his bank card or the money in his Paypal account.

4.1.3. Post-payment – If LatvianCrafts.lv section "Contacts" states that orders can be picked up in person, they can also be paid at the time of receipt at the Seller's office, by contacting the Seller in advance about the date and time of receiving the goods.

 

5. Receiving and delivery of goods

5.1. The goods are handed over to the Buyer only after full payment of the order.

5.2. When ordering goods, the Buyer can choose one of the methods of receiving and delivering the goods: Postal package, Omniva parcel machine, courier delivery or receiving the goods at the office.

5.3. Receiving the goods at the office - When ordering goods at Latviancrafts.lv, in the field about the delivery of the goods, the Buyer can indicate "Receive the goods at the office". When the order is completed, the Seller sends an SMS to the phone number specified by the Buyer and the date and time of receiving the goods is agreed upon. If the Buyer's order is paid for, it may be stored for up to 30 days at the Seller's office. If the order is not picked up within this time period, it will be canceled by returning the order amount to the Buyer. If the order has not been refunded, it is stored for 5 working days, after which it is canceled if the Buyer and the Seller have not agreed on a pick-up date.

5.4. Courier deliveries are provided only in Jurmala - Riga territory. The date, time and place of delivery are agreed when the Seller communicates with the Buyer.

5.5. Delivery times, terms, costs and conditions are indicated in LatvianCrafts.lv section "Delivery" (https://www.latviancrafts.lv//en/pages/apmaksa-piegade).

5.6. In the event that the goods ordered by the Buyer are not available in the warehouses and they must be specially ordered from the manufacturer, as well as in other unforeseen cases, the Seller informs the Buyer about the possible delay in delivery. In the event that the Buyer has lost interest in purchasing the product due to its delivery deadline, the Buyer has the right to cancel the Order and the amount paid by the Buyer (including transport costs) is returned to the Buyer.

5.7. It is the responsibility of the buyer to follow the correctness of the contact information when placing the order in order to avoid delays and misunderstandings when delivering the goods. The Seller and the Courier are not responsible for delays and misunderstandings in the delivery of goods, which occurred in the event of data inaccuracies when placing an order.

5.8. If delivery to the Buyer is not possible due to the Buyer's fault, and the Buyer has not notified in time about the impossibility of accepting the product, the Buyer shall bear the cost of re-delivery of the product.

5.9. The buyer undertakes to accept the goods himself by presenting a valid identity document. If the Buyer does not accept the goods himself, even though the goods have been delivered to the address indicated by the Buyer, the Seller has the right to hand over the goods to another person located at the indicated address, and the Buyer will not have the right to make any claims to the Seller about the delivery of the goods to the wrong person.

5.10. After receiving the goods, the Buyer checks the compliance of the delivered Goods with the ordered Goods and the ordered quantity. If the Buyer finds that the shipment does not contain the appropriate amount of goods or that goods that do not correspond to the order were delivered, the Buyer must inform the Seller immediately, no later than on the day of receipt of the Goods, otherwise it is considered that the goods corresponding to the order, in the quantity corresponding to the order, were delivered. The Seller will contact the Buyer to arrange compensation for the missing goods.

 

6. Warranty and right of withdrawal

 

6.1. Before starting to use the purchased product, the Buyer must read the instructions for use of the product (if one is attached to the product). The product must be used in accordance with its manufacturer's instructions, according to the characteristics of the product and the intended purposes of use.

6.2. The warranty for the products offered by LatvianCrafts.lv is provided in accordance with the warranty service conditions set by the manufacturer of the product, but not less than 2 years.

6.3. If the Buyer has purchased a product with a defect, it is mandatory to contact the Seller to agree on the exchange of the product.

6.4. It is the buyer's responsibility to keep and not damage the original packaging of the ordered item.

6.5. According to the Consumer Rights Protection Law of the Republic of Latvia, the Buyer can exercise the right of withdrawal and unilaterally withdraw from the distance contract within 14 calendar days and return the purchased product to the Seller. The Buyer can submit a return in a free-form email, sent to LatvianCrafts@LatvianCrafts.lv.

6.6. The seller undertakes to refund the direct costs of the goods within 14 days from the day of receiving the "notice of refusal", excluding the costs of returning the goods (Postal, Omniva, etc. services). The Seller has the right to withhold the refund to the Buyer until the product or its shipping documents are received.

 

6.7. The consumer is responsible for the decrease in the value of the product if the product is used for a purpose other than to determine the nature, properties and operation of the product. The buyer has the right to check the characteristics of the product to the extent that it would be possible to do so in a regular store.

 

7. Final provisions

7.1. All disputes between the Seller and the Buyer are resolved through negotiations, if this is not possible - in accordance with the procedure established by law.

7.2. In case of non-compliance with the buyer's rights, it is possible to turn to the Consumer Rights and Protection Center (www.ptac.gov.lv)
